Promotions Product Terms and Conditions

This agreement states the terms & conditions regarding the promotion and sale of your tourism product and merchandise (hereinafter referred to as ‘You’  or  ‘Your’)  by  the  Western  Australian  Visitor  Information  Centre  (WAVC).   All  transactions  and  all  documentation  pertaining  to  business conducted will be processed by the Western Australian Visitor Information Centre and hereinafter referred to as ‘our Company’.   Our Company ABN is 59 155 112 584 and our Company ACN is 155 112 584. 

Prices and Booking Conditions
1. Persons wishing to book Your product through our company must be 18 years or older.
2. Your product sold through our Company will be advertised at the rate provided by You.   Tourism Products are required to provide a retail rate along with a net rate, the difference equating to the commission rate earned by our Company acting as reseller of Your product.   Merchandise suppliers are required to provide a net rate and suggested retail rate, the difference being the margin rate earned by our Company whilst acting as a reseller of Your Merchandise.   
3. Prices and conditions as given by You will be current at the time of publication but subject to change by You without notice.   All prices given and shown are in Australian Dollars and include GST where applicable. 
4. The terms and conditions for the sale, change or cancellation of Your product will be displayed on our Company’s Booking Form.
5. Our Company reserves the right to promote Your product through the best possible manner to achieve a positive outcome for all parties.   This may be through standalone or packaged options of Your product.   All promotions will be carried out in a manner that highlights Your product in the best possible manner.     

Payment by Purchaser to WAVC
6. Full or partial payment must be received by the Purchaser at the time of booking Your product with our Company.   A confirmation / tax invoice will be provided to the Purchaser at the time of purchase.
7. Once payment is made, relevant documentation and a booking confirmation will be issued by our Company to You.   This confirmation may be presented by the Purchaser to You on arrival at Your product. 

Payment by WAVC to You
8. The WAVC will remit directly into Your bank account the gross amount of the rate given to our Company less the commission or margin rate at the end of each month.   A Recipient Created Tax Invoice will be issued with payment.   

Refund, Amendment and Cancellation Conditions
9. In the event of any Refund, Amendment or Cancellation to the booking of a product or the sale of merchandise our Company will apply Your Terms & Conditions when calculating any refund, amendment or cancellation and a refund to the Purchaser may apply.
10. In the event of an amendment to a confirmed booking made by our Company, an administration fee of $25.00 (Inc. GST) will be charged directly by our Company to the Purchaser.   An additional amendment fee levied by You may also apply to that Purchaser depending on the individual policies of Your product. 
11. In the event of cancellation to a confirmed booking made by our Company, an administration fee of 15% of the total cost of the booking will be charged directly by our Company to the Purchaser.   An additional amendment fee levied by You may also apply to that Purchaser depending on the individual policies of Your product.   In any event Your Terms and Conditions as stated by Your Company will apply to the booking.   

Responsibility
12. The product sold by our Company will vary from one service provider to another therefore it is the responsibility of the Purchaser to ensure any product booked is suitable for their needs.
13. The products offered by our Company will be the responsibility of You and no guarantee or warranty for the type or quality of products and services advertised is offered or inferred by our Company.
14. While every effort is made to ensure the accuracy of information included in our promotions no responsibility can be accepted by our Company for any changes, errors or omissions to the information included.
15. No responsibility can be accepted for any loss or inconvenience caused directly or indirectly  through participation in our promotions  or the purchase of products and services available from our Company.
16. Whilst bookings made by our Company with You are on the basis that Your product for the required dates are available at the time the booking is made, our Company is not responsible for any overbooking which has been made by You and therefore any compensation requested by the Purchaser will need to be obtained directly from You. 

Supply of Promotional Material and Merchandise 
17. Promotional display material and Merchandise must be delivered to the WAVC in a timely manner relevant to the dates of the promotion.
18. Whilst our Company will endeavour to protect Your display material and Merchandise whilst it is under our control our Company will not be held liable for any damage that occurs whilst in our care.   It is highly recommended that insurance be taken out to cover any unforeseen circumstances.
