Cancellation Policy and Terms and Conditions This website is owned by Adventurous by Nature Pty Ltd as trustee for the Hile Family Trust trading as Adventurous Women® (ABN 96 475 116 939) herein after referred to as "Adventurous Women® " unless otherwise specified. Use of this website is subject to the following Terms & Conditions and applies to any booking made through the website or through direct contact with Adventurous Women® . In these booking terms and conditions "you" and "your" means all persons named on the booking (including anyone who is added or substituted at a later date). "We" "us" and "our" means Adventurous Women® . "Service Provider/s" means Third Party. 1. Overseas Travel Related Adventures - Adventurous Women® is not a licensed travel agent (Travel Agents Act 1985) nor a carrier or hotelier nor do we own aircraft hotels or coaches. The services Adventurous Women® provide consists of arranging and coordinating accommodation tours and transfers escorting tours and introducing clients to various third party travel service providers. We exercise every care in the selection of reputable travel agents airlines tour operators coach operators hotels and other service providers of the various travel services which are used in these tours. It is important to note therefore all bookings with Adventurous Women® are subject to the terms conditions and limitations of liability imposed by the service providers whose services we utilise some of which limit or exclude liability in respect of death personal injury delay and loss of damage of baggage. Because of this Adventurous Women® does not accept liability for events beyond our control nor liability for accidents incurred due to actions taken at your own risk. Each of our Tour Operators/Service Providers have their own booking conditions & cancellation policy over and above those of Adventurous Women®. Please ensure you request them and read them carefully. Adventurous Women® 's Cancellation Policy for Overseas Travel can be viewed below. Please ensure you read our Cancellation Policy carefully as by paying your deposit you acknowledge that you accept our cancellation policy and that of our Service Providers. Adventurous Women® Cancellation Policy - Overseas Travel: Cancellation of More than 70 days - Loss of 30% of Tour Cost Between 69 and 31 days - Loss of 50% of Tour Cost 30 days or less - Loss of 100% of Tour Cost 2. Events Activities & Tours "Adventures" Provided by Solely by Adventurous Women® - In many circumstances Adventurous Women® provide events activities and tours run independently of any external service provider. This being the case when you book and make a payment your contract is between you and Adventurous Women® . 2a) Duration of each adventure advertised by us is approximate. Any itinerary provided to you is indicative only and the order of the events may change. 2b) Certain adventures we provide are subject to minimum age health or other restrictions. It is your responsibility to check these restrictions with us. 2c) Adventure photographs/descriptions are representative only. Images are either purchased by ourselves or are images that we own. The images used by Adventurous Women® are protected by copyright and must not be copied in whole or in part without the written permission of Adventurous Women® . 2d) Adventurous Women® is not liable for any inconvenience caused or expenses incurred by use of any information provided on our website. Adventurous women disclaims all liability for any errors unauthorized access to your personal information or inaccuracies of information supplied by third parties. Adventurous Women® will not be liable for direct indirect consequential or incidental damages including but not limited to lost profits savings or damages. 2e) All the material on our website is subject to the copyright of Adventurous Women® or its third party service providers. You must not reproduce any of the material contained on the website unless it is for your own personal use. You may not provide a link to our website from another website without Adventurous Women® 's written consent. 2f) Some of the adventures we run are considered dangerous. We hold a current 10 Million Public Liability Insurance Policy but we recommend that you acquire your own insurance cover which is your responsibility. Prior to participating in any adventure you should be aware of the risks involved. Adventurous Women® can provide further information if you are in any doubt about any adventure. 2g) By taking a tour with Adventurous Women® you are aware that they involve risks and you do hereby assume all responsibility of risk and release Adventurous Women® staff and associates from all liability causes of action debts claims and demands of every kind and nature whatsoever that may arise out of or in connection with an Adventurous Women® tour including any pre-existing injury or condition. 2h) The Adventurous Women® website may include links to other websites that are operated by third parties ("Third Party Websites"). Adventurous Women® does not accept any responsibility for your use of the Third Party Websites and have not checked: (1) the accuracy or completeness of any information; or (2) the suitability or quality of the goods and services made available on the Third Party Websites. Your use of the Third Party Websites may be subject to separate terms and conditions displayed on the Third Party Websites. You acknowledge that Adventurous Women® may receive commissions in respect of goods or services that you purchase on a Third Party Website when you access that Third Party Website using a link from our Website. For instance Travel Insurance is provided by 'Travel Insurance Direct' so when you click on the insurance banner you will be redirected to a website operated by Travel Insurance Direct. If you do not agree with any part of these terms and conditions you must not use the Website. Adventurous women excludes all liability to you in relation to your use of the Website. 2i) All Prices quoted are in Australian dollars include GST and are correct at time of publication. Adventurous Women® reserves the right to change prices without notice. 2j) By selecting the "Book Now" or "Pay Now" button or downloading any booking material or by accessing any data information or material using the Website you agree to be bound by these terms and conditions. 2k) Our Cancellation Policy can be viewed below: Cancellation of More than 70 days - Loss of Deposit or Loss of 30% of Cost of Tour Activity or Event (Whatever the Greater Amount) Between 69 and 31 days - Loss of 50% of Cost of Tour Activity or Event 30 days or less - Loss of 100% of Cost of Tour Activity or Event Booking Terms & Conditions for all existing bookings impacted by COVID-19. The outbreak of the Coronavirus (COVID-19) pandemic is a force majeure which is an event that occurs outside of the reasonable control of either party. If we are forced to cancel due to a force majeure you can choose from the following options based on the payments you have already made: Cancellation of your booking before final payment is made: If you have only made a deposit on your booking you can choose to transfer your deposit to an alternative tour or activity up until 30 June 2021. No cancellation fee or surcharge will occur. If you have paid in full for any multi-day tour: We will hold your funds in credit to be used for a future tour taken by 30th June 2021. No refunds are available. If you have paid in full for any day activity: We will refund you in full or at your request transfer the funds to another activity of your choosing to be taken by 20th June 2021. Please note that the above COVID-19 Impact Booking Conditions apply to Adventurous Women Tours & Activities run solely by Adventurous Women. These conditions do not apply to airlines and external service providers or third party tour operators or travel agents who operate tours or take payment for tours on behalf of Adventurous Women each have their own booking terms & conditions. 3. Events Activities & Tours "Adventures" Provided by Third Party Service Providers - In some circumstances Adventurous Women® acts as an agent only. Adventurous Women® acts as an agent for third party service providers for the purposes of marketing their service or adventure. In this instance when you undertake an adventure with a service provider other than Adventurous Women® your contract is between you and the service provider and you will be subject to the Terms and Conditions of that service provider. Adventurous Women® will on request provide these Terms & Conditions prior to accepting any payment from you. Please ensure you read them carefully as by making a payment you acknowledge that you accept these booking conditions. Adventurous Women® make no guarantees or warranties implied or otherwise about the services that are provided to yourself by our service providers. 3a). Adventurous Women® has no liability for any damage or loss caused by any negligent omission or act of any service provider or third party. Adventurous Women® has no liability for any act default or omission whether negligent or otherwise of any service provider. Where Adventurous Women® 's liability cannot be excluded such liability is limited to the value of the adventure purchased. 3b) Duration of each adventure advertised by us is approximate. These duration times are given to us by the service provider as a guide. Any itinerary provided to you is indicative only and the order of the events may change. 3c) Certain adventures provided by our service providers are subject to minimum age health or other restrictions. It is your responsibility to check these restrictions with the service provider. Contact details of each service provider are given when a booking is confirmed. 3d) Adventure photographs/descriptions are representative only. Images are either supplied by the service provider purchased by ourselves or are images that we own. The images used by Adventurous Women® are protected by copyright and must not be copied in whole or in part without the written permission of Adventurous Women® . 3e) Adventurous Women® is not liable for any inconvenience caused or expenses incurred by use of any information provided on our website. Adventurous women disclaims all liability for any errors unauthorized access to your personal information or inaccuracies of information supplied by third parties. The content or format of some of the adventures may change slightly from time to time so we do recommend you check this with the service provider. Your participation in each adventure is subject to your acceptance of the service provider's Terms & Conditions. Adventurous Women® makes no specific representation as to the standard class or description of services provided by third parties including the service providers. Adventurous Women® does not accept liability for any errors or omissions and reserves the right to change information published on our website. It is your responsibility to check our website from time to time for possible changes. 3g) All the material on our website is subject to the copyright of Adventurous Women® or its third party service providers. It is a requirement that our service providers hold current Public Liability Insurance. Responsibility rests with you to make your own enquiries with the service provider and other third parties as to the need to acquire your own insurance cover. 3i) The Adventurous Women® website may include links to other websites that are operated by third parties ("Third Party Websites"). Adventurous Women® does not accept any responsibility for your use of the Third Party Websites and have not checked: (1) the accuracy or completeness of any information; or (2) the suitability or quality of the goods and services made available on the Third Party Websites. The person making a booking acknowledges to have accepted these terms and conditions on behalf of everyone named in the booking. 3k) By selecting the "Book Now"or "Pay Now" button or downloading any booking material or by accessing any data information or material using the Website you agree to be bound by these terms and conditions. 3l) Each Third Party Service Provider have their own Booking Conditions and Cancellation Policies. It is your responsibility to request these details prior to making any booking or payment.
